South Africa, 62 million people, built its family law on the 1996 Constitution and its equality clause: the Civil Union Act 2006 opened marriage to same-sex couples, the Recognition of Customary Marriages Act 1998 gave customary and polygamous marriages full legal effect, the Divorce Act 1979 provides no-fault divorce and the Children's Act 2005 governs parental responsibilities. Marriage is possible from 18.
The Choice on Termination of Pregnancy Act 1996 allows abortion on request up to twelve weeks and on broad grounds to twenty, the Domestic Violence Act 1998 — strengthened in 2021 — provides protection orders, and the Protection of Personal Information Act has been fully in force since 2021.
