The legal framework
The Women's Charter governs civil divorce. A party generally cannot file until the marriage has lasted three years. The sole ground is irretrievable breakdown, proved by one of the statutory facts — to which divorce by mutual agreement was added in 2024. Muslim marriages come under the Syariah Court.
Key points
| Three-year bar | Filing before three years requires leave, granted only for exceptional hardship |
|---|---|
| Facts | Adultery, unreasonable behaviour, desertion, separation (3 years with consent, 4 without), and mutual agreement since 2024 |
| Two-stage process | Interim judgment, then final judgment, usually after three months |
| Matrimonial assets | Divided on a just and equitable basis, with express recognition of indirect and homemaking contributions |
| HDB flat | Subject to housing policy rules on retention, sale and eligibility |
| Maintenance | For the wife and, in defined circumstances, for an incapacitated husband |
| Parenting | Mandatory parenting programme for divorcing parents with minor children |
| Divorce by mutual agreement | Added in 2022 as a further fact, without alleging fault |
| Matrimonial home | Public housing rules strongly shape the outcome |
| Syariah Court | Muslim divorces proceed there under a separate law |
In practice
- Check HDB eligibility rules early: they often drive the whole settlement.
- Attend the mandatory parenting programme if you have minor children under 21.
- Simplified track is available where everything is agreed.
- CPF monies used for the flat must be accounted for in any division.
- Take housing advice before agreeing anything about the flat: eligibility rules constrain the options.
- Consider the mutual agreement route, which avoids alleging unreasonable behaviour.
Cost and coverage
Court fees are moderate; the simplified track keeps costs low. Legal aid is means-tested through the Legal Aid Bureau.
Recent changes
The mutual agreement ground introduced in 2024 allows couples to divorce without blaming each other, provided they set out the reasons and the efforts made at reconciliation.

Worth knowing
Housing is the pressure point in Singapore divorces: eligibility to retain or buy a flat depends on citizenship, age, custody and the minimum occupation period. Get advice on that before negotiating anything else. Eligibility rules for public housing determine who can keep the flat and when it can be sold. They often matter more than the division formula.
