The legal framework
The Irish courts have recognised privacy as an unenumerated personal right under Article 40.3 of the Constitution. Day to day, the GDPR and the Data Protection Act 2018 do the heavy lifting, and the Data Protection Commission supervises many of the largest technology companies because their European headquarters are in Ireland.
As a member state of the European Union, this country's privacy protection sits within the framework of the Charter of Fundamental Rights and Directive 2002/58/EC on the confidentiality of electronic communications, alongside the separate European Convention on Human Rights.

In practice
- Send a written access request first: it forces the other side to disclose what it holds and creates a paper trail.
- Screenshot everything, with the date and the URL visible, before asking for removal.
- Complain to the regulator — it is free — and keep the reference number.
- Court action is the last step, and the limitation periods are short: take advice early.
- Use the Circuit Court for modest claims: the costs exposure is far lower.
Where to go
- Data Protection Commission.
- Office of the Press Ombudsman.
- Free Legal Advice Centres.
Worth knowing
The Data Protection Commission handles a very large caseload as lead authority for many global platforms, so complaints about big tech can take a long time. Say clearly what outcome you want. The constitutional right to privacy exists alongside data protection law, so a claim can be framed in both ways at once.
