The news in brief
The regulator found unauthorised financial services and misuse of client funds in the Datum/Kgaphola matter.
The FSCA announced an administrative penalty of R300,000 and a 20-year debarment against Joy Praise Kgaphola, the sole director of Datum RS (FSCA, 23 October 2026). The investigation looked at investment offers promoted through the company’s social-media accounts.
The regulator found that the advertised packages offered trading in derivatives and crypto assets without the necessary authorisation. It also found that money paid into Kgaphola’s personal accounts was spent on personal purchases rather than the promised investments. These findings are attributed to the FSCA. The announcement says the matter will be referred to the criminal authorities, and it does not report a criminal conviction (FSCA investigation).
The case shows why a prominent account, professional-looking investment packages and promises of rapid returns cannot show that a provider is authorised. The FSCA search service is the official starting point for checking registration. Check the identity of the person and the service on offer, not just a name displayed on a social network.
A penalty paid to the regulator is not the same as repayment to clients (Financial Sector Regulation Act, section 167(1)). Anyone affected should keep the original offer, the payment details and all correspondence. The sanction the regulator announced does not, by itself, confirm an individual refund or replace the separate reporting and claims processes.
